Amity’s Acceptable Use Policy

Amity’s goal is to create a positive and safe online community experience. To promote this goal, we discourage and prohibit certain types of conduct that may be harmful to other users or to Amity. With Amity’s services, we grant you the access to the Amity application program interface(s) (API(s)), webhook, sample software code, and other related websites, networks, applications, SDKs, and other materials provided or made available by Amity (together, the “Platform”) that enable you to implement the Amity social, chat, live video and bot platform services offered by Amity (collectively, the “Services”) on one or more website(s), web application(s), or mobile application(s) owned and controlled by you.

This Acceptable Use Policy sets out a list of acceptable and unacceptable conducts for our Services. Please read it carefully. You are responsible for your use of our Services and for any use of the Services made using your account.

To use Amity’s Services, you warrant that you meet the qualification listed below:

  • You are over 18 years old (or reaching the minimum legal age in your country to use our Services).
  • You are not a convicted sex offender.
  • Your account has never been suspended or terminated by Amity due to the  violations of our terms or policies.
  • You are not prohibited from receiving our products, Services or software under applicable laws.
  • You have not previously been suspended or removed from the Platform or Services. 

When you use our Services, you agree that you shall:

  • comply with the Amity’s Terms and Conditions including our Privacy Policy, Cookie Policy and this Acceptable Use Policy;
  • comply with all applicable laws and regulations;
  • keep your password and login information confidential and use reasonable effort to prevent unauthorized access to the Services;
  • permit any third party that is not an authorized end user to access or use a username or password for the Services;
  • Monitor all activity conducted through your account in connection to the Services and promptly notify Amity if you become aware of any illegal or unauthorized activity or security breach involving your account or another authorized end user’s account.

When you use our Services, you agree that you shall NOT:

  • permit any third party that is not an authorized end user to access or use a username or password for the Services;
  • share your password and login credentials with another person or otherwise provide access to an account designated for you to another person;
  • use the Services to store or transmit any data that may violate or infringe someone else’s trademark, copyright, or other intellectual property right, or that may be tortious or illegal;
  • use the Services to disseminate confidential information concerning any other person or legal entity to which you or the customer don’t own all required rights under the law;
  • transmit to or from the Services any data, file, software, or link that contains or redirects to a virus, trojan horse, worm, or other harmful components or a technology that illegally accesses contents or information stored within the Services;
  • attempt to interfere with, hack, disable, modify, copy or disrupt the features, functionality or integrity of the Services or any third party use of the Services;
  • avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any security measure implemented by Amity or any other third party (including another authorized end user);
  • transmit anything that is unlawful, abusive, harassing, harmful to reputation, pornographic, indecent, profane, obscene, hateful, discriminatory, racist or otherwise inappropriate to Amity’s goal;
  • send unsolicited or unauthorized advertising, commercial communications or spam;
  • impersonate or misrepresent your any person or entity, including, but not limited to, an employee of Amity or a customer’s authorized end user, or falsely state or otherwise misrepresent your affiliation with a person, organization or entity;
  • register for more than one Amity account or register for an Amity account on behalf of an individual other than yourself;
  • advocate, encourage, or assist any third party in doing any of the above provisions.

Amity shall be entitled to investigate and prosecute violations of any of the above to the fullest extent permitted under applicable laws. If we believe a violation of this Acceptable Use Policy is deliberate or presents a real risk of harm to other authorized end users, our customers, the Services or any third parties, Amity reserves the right, at any time and without prior notice, to suspend or terminate your access to the Services.

Intellectual Property

The Services are entirely owned by Amity and it is licensed, not sold, to you. All the elements of the Services are protected by copyright and trademark laws, international conventions, and all other applicable laws. You hereby acknowledge that you will not acquire rights, title or interest to the Product, other than what set forth in these terms.

You acknowledge that Amity is currently developing and will subsequently develop new features and modules of the Services, hence its form and the nature might change in the future. Nothing in these terms shall impair or limit Amity’s right to continue with the development, maintenance and/or distribution of Services and any other existing or future products.

Additional provisions

1)  Updating terms on Acceptable Use Policy

We work constantly to improve our Services and develop new features to make our products better for you and our community. As a result, we may need to update these terms from time to time to accurately reflect our Services and practices. We will only make changes if the provisions are no longer appropriate or if they are incomplete, and only if the changes are reasonable and take due account of your interests.

We hope that you will continue using our Service, but if you do not agree to our updated terms and no longer want to be a part of the Amity’s Platform, you can delete your account at any time.

2) Account suspension or termination

We want our Platform to be a safe and secure place for everyone. Therefore, if we determine that you have clearly, seriously or repeatedly breached our terms or policies, we may suspend or permanently disable access to your account. We may also suspend or disable your account if you repeatedly infringe other people's intellectual property rights or where we are required to do so for legal reasons.

Where we take such action, we'll let you know and explain any options you have to request a review, unless doing so may expose us or others to legal liability; harm our community of users; compromise or interfere with the integrity or operation of any of our services, systems or products; or where we are restricted due to technical limitations; or where we are prohibited from doing so for legal reasons.

3) Disputes

We try to provide clear rules so that we can limit or hopefully avoid disputes between you and us. If a dispute does arise, however, it's useful to know upfront where it can be resolved and what laws will apply.

If you are a consumer, the laws of the country in which you reside will apply to any claim, cause of action or dispute that you have against us that arises out of or relates to these terms or Amity’s Services, and you may resolve your claim in any competent court in that country that has jurisdiction over the claim. In all other cases, you agree that the claim must be resolved exclusively in the United Kingdom, at the Court of London. You also agree that you submit to the personal jurisdiction of either of these courts for the purpose of litigating any such claim, and that the laws of England and Wales will govern these terms and any claim, without regard to conflict of law provisions.
